Terms of Service

You must be at least 18 years old to create an account on Surfaway. By registering, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement under applicable law.

To access most Platform features, you must create a personal account ("Account"). You agree to:

• Provide accurate, current, and complete information;
• Maintain and promptly update your account information;
• Keep your login credentials secure and confidential;
• Accept responsibility for all activities under your Account.

Surfaway reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

Surfaway acts solely as an intermediary between Hosts and Volunteers and:

• Does not employ, represent, or endorse any user;
• Does not supervise or control user conduct;
• Is not a party to any agreement between Hosts and Volunteers;
• Provides the Platform "as is", facilitating communication and connection only.

Any arrangement between a Host and Volunteer is made entirely at the users' discretion and risk.

By using Surfaway, you agree to:

• Use the Platform only for lawful purposes;
• Treat all users respectfully and refrain from discrimination or harassment;
• Refrain from posting false, misleading, or defamatory content;
• Not use the Platform for spam or commercial solicitation without Surfaway's consent;
• Respect the community principles of surfing culture and environmental stewardship.

Surfaway reserves the right to remove any content or suspend users who violate these Terms.

• Provide accurate descriptions of volunteer opportunities and expectations;
• Ensure accommodations meet reasonable safety and hygiene standards;
• Refrain from exploiting volunteers or requiring excessive work;
• Comply with local laws, employment, and visa regulations;
• Respect volunteers' privacy and dignity.

Hosts are solely responsible for their listings and agreements with Volunteers.

• Provide accurate profile information and availability;
• Communicate clearly with Hosts regarding expectations and plans;
• Fulfill agreed-upon responsibilities in good faith;
• Respect the Host's property, rules, and culture;
• Refrain from behavior that may endanger themselves or others.

Volunteers participate entirely at their own risk and must ensure they have appropriate travel insurance.

Users retain ownership of content they submit (profiles, photos, messages) but grant Surfaway a non-exclusive, worldwide, royalty-free license to use and display such content solely for Platform operation, marketing, or community promotion.

You agree not to:

• Use bots or scrapers to access Platform data;
• Post offensive, illegal, or pornographic material;
• Misrepresent your identity or create fake accounts;
• Solicit money or services under false pretenses;
• Upload malware or attempt to compromise site security.

Violations may result in immediate termination and legal action.

• Surfaway is not responsible for arrangements or disputes between Hosts and Volunteers;
• Surfaway is not liable for loss, injury, or damage from Platform interactions;
• Surfaway is not responsible for user content;
• All users connect at their own risk.

You agree to indemnify and hold harmless Surfaway, its affiliates, and partners from claims or expenses arising from your breach of these Terms, conduct, or content on the Platform.

All intellectual property, including logos, trademarks, design, and software, is owned by Surfaway or its licensors. Unauthorized use or modification is strictly prohibited.

Surfaway may suspend or terminate your account if you breach these Terms, misuse the Platform, or engage in fraudulent or unsafe behavior. Upon termination, your right to access the Platform ceases immediately.

Surfaway may modify, suspend, or discontinue parts of the Platform at any time without notice, though major changes will be communicated to registered users.

These Terms are governed by international principles of contract law. In case of disputes, users agree to attempt amicable resolution first, and if unresolved, submit to binding arbitration under U.S. rules.

If any part of these Terms is found invalid, the remaining provisions remain in effect.

Entire Agreement

These Terms constitute the entire agreement between you and Surfaway regarding Platform use and supersede prior communications.
